You will have a business address for this builder!
Visit his registered office and wait in reception until you get attention.
Have copies of your Invoices to hand to him and confirm your terms of trading.

If he has exceeded your agreed final payment terms - issue a county court summons for non payment asap.
He will have to respond within 14 days!

Despite the fun element in some of the posts you must keep a proffessional stance and start proceedings as soon as your terms have been broken. The longer it goes on the more excuses he will find and you will end up owing him money!

I completely agree. I recently had a problem with a customer who didn't want to pay, the job went smoothly and they were happy as Larry while the work was going on and soon as I finished it all changed, the terms were payment on completion and they refused and said they needed 2 days to check it over, not a problem (even though they went over the work with a fine toothcomb at the end of each day).

I had a feeling these people were going to mess around as while the works were going on they changed the spec countless times, they would fire off an email with changes and added extras, I’d give a price via email and I’d get an email back agreeing to the price but on more than one occasion they tried to sneak in more extras and claim I had agreed to do it (the cheek:yikes:), to which I’d have to send another email stating that the price only included what was in my email and not the edited versions they would send back! It was mentioned to me that the guy was a solicitor so I made sure EVERYTHING was in writing, most of the time I agree small extras verbally but not with these people!

Anyway I agreed they could have some time to check the work, the deadline passed and they asked for more time, I agreed. more time passed and more time given - 5 times in fact, when they asked for the 6th time (3 weeks later) I refused and said if they have a problem then I expect a letter with the reasons they are refusing to settle their debts and followed up with phone calls all of which went unanswered (20 missed calls) - they paid up straight away then said they are going to take me to court for harassment!! The guy was trying to get one over on me, not for any other reason but just that’s the sort of person he is, he thought because he was a solicitor it would scare me, in fact it was like a red rag to a bull that he would use such tactics against me and in any case I’m a better solicitor then him because the only way he can do me for harassment is if I left messages or demanded payment in such a way that would cause embarrassment, (such as leaving messages on a home phone that his family might hear). Which I didn't:prrr:.

3 weeks has passed and I haven't heard a thing, muppet!

So I’ve gone a very long way about telling you! Don't cause embarrassment to him by chasing the debt as courts may rule that you cannot recover the debt because of it.

good words there i myself have encountered this before with a kitchen company sometimes i would wait months for payment i tried laying the law down but to no avail. Then eventually i took legal advice and threatend court action i sent them a letter as soon as they received it my phone rang i went to their office payment sorted since then we ve maintained a good relationship try go through the right channels and my bet is that the builder will contact you keep at it eventually he may cave in

Trouble with court is, he will claim he has no money but agree to pay £10 per week. Judge will be happy with that. 3 weeks later he stops paying. Then you have to start all over again

That's if it gets to that stage!
He will only go the whole way if he feels he has a case against you or in actual fact has no money!
How many people want their name on a court register.

Hi guys

me again :incazzato: of "what a bodge in the bathroom". This sort of drops into my area in regards to the courts and I have been doing a lot of reading on Small Claims as the other side has a solicitor trying to be big and clever.

They have 14 days from a 'ruling' to cough up. If not then you do not have to start all over again - I have not read anywhere about you having to accept small payments. If they do not pay you then carry on - the decision stands and you can go all the way to you can apply to put a charge on their property. Even force them to sell it for a loss to settle your bill

Let them try and sell the new build with one of them charges registered against it!!!
