Thats a really interesting question and i feel the only person that can answer that is a solicitor who specialises in that field , but im sure one question that will be asked of you is this , to know that it is dot and dabbed you probably saw the work during the process and if you felt it was being done incorrectly why did you not stop your contractor .

I didn't see the tiler and was informed about dot and dab when making enquiry about why I'm seeing damp circles on the tiles like dominoes after a bath or shower

If this method is used and the work doesn't fail or have any visible defects (damp circles) after completion, I can't see how a court can do anything to make the work be redone.
Surely the courts can only use / consider the fixing method if a failure occurs or the finished job looks faulty.
I think it would be a very brave /foolish person to go to court and hope to get work redo only because the chosen fixing method, "dot and dab", has been used and the job hasn't failed, not all do.
Just some thoughts to start a debate 🤔

We need to know what adhesive has been used. Your best course of redress imho is to say he hasn't followed the adhesive manufactures instructions for fixing, ie stability for tile, fixing method, wall prep.

Sounds like you have water ingress to as the dots must be getting wet to cause the cicles

The circles are after a shower or bath and dry out after a couple of hours when the heating is on. Work only done before Xmas and tiles direct to wall which is external. Asked the tiled a few questions about using dark adhesive on a light tile but not very friendly in response, didn't know to look out for d and d.

the cold from the wall is transferring thro the adhesive to the tile which is condensating causing the wet circle. The air pocket between the dabs is acting as a barrier hence warmer spot around the dabs. once heating is on the tiles uniformly warm so no condensation.... just my thoughts

Does this lead to build up of moisture behind the tile for future problems

all depends on the quality and integrity of tile and grout. at very least you should seal grout with a quality sealer. I think you will always have the wet circle problem until you ripout and redo.prob board walls before tiling if they cold
