Fekin has some valid points in his post and we could go round all day discussing who ulitamatley is at fault. This is not our place. Like grumpy says
First seek legal advice, second refer the matter to insurance company and then see what transpires. You could discuss the situation with the customer "without prejudice" awaiting the outcome of legal and insurance.
That is the reason liability insurance is paid and it is for them to sort out. As for blame insurance companies state do not admit blame under any circumstances
even if you feel you are at fault.
Another point that has not been touched on is how this accident has affected the work asked to be carried out. Has this accident meant that the job has gone elsewhere?
Beleive it or not I also have a lot of dealings when it comes to health and safety this includes inductions, method statements and risk assesments.
An accident is something that could have been avoided if the correct methods to prevent had been in place. Accidents do not just happen.
Therefore if the sheet had not been placed there or the switch been made unable to fuction then this "accident "would not have happend.
