last year I worked for a security company. They sent me to a site where I had to close a 42 foot metal gate which promptly came off its runner and smashed my toes.
turns out it had happened a few times before but not hurt anyone. My company knew about it, the site owners knew about it and the guy who I relieved knew but no one told me.
when I called accident helpline they chose to go for my employer and I got paid out

Fekin has some valid points in his post and we could go round all day discussing who ulitamatley is at fault. This is not our place. Like grumpy says

First seek legal advice, second refer the matter to insurance company and then see what transpires. You could discuss the situation with the customer "without prejudice" awaiting the outcome of legal and insurance.

That is the reason liability insurance is paid and it is for them to sort out. As for blame insurance companies state do not admit blame under any circumstances
even if you feel you are at fault.

Another point that has not been touched on is how this accident has affected the work asked to be carried out. Has this accident meant that the job has gone elsewhere?

Beleive it or not I also have a lot of dealings when it comes to health and safety this includes inductions, method statements and risk assesments.

An accident is something that could have been avoided if the correct methods to prevent had been in place. Accidents do not just happen.

Therefore if the sheet had not been placed there or the switch been made unable to fuction then this "accident "would not have happend.

Anyway as I stated before it is not our place to decide so Fekin we will agree to disagree and let those whose job it is decide.

Just got in from work to find this thread has generated alot of useful commments arguing for both sides.
Im a new member since yesterday and this forum has certainly helped me think about everyones point of view but in the end I still have the same sense of responsibility.
If my firm had not been warned there would be no argument. But we were and I think the client feels that it is not solely my fault either and they are good honest people.
Just unfortunate that i was on holiday, the foreman was off sick the first day and of course no one expects accidents to happen until they do and then it becomes obvious what we all should have done.

Of course clients employ professionals like ourselves because they dont understand the practicalities and correct method of doing things and allowances must be made.

The client and extended family have given me alot of work in past and my guys have got on very well with them till this episode, so im fairly sure we can reach a mutually agreeable conclusion.

So I think we draw a close to this debate and thanks to everyones input.
Dont think youll be passing the hat round for me though!!!

Still it wont be as painful an experience as a job I had in South Africa some years ago where the cleint threatened to break my arms within twenty minutes of arriving in his country if my work wasnt up to his expectations. We got arrested coz he hadnt sorted the right visa out .Then I got arrested for passing counterfeit money in a casino that he gave me for wages. Threatened to do me in at a site meeting in front of 6 others inc architect/desingers/ builders etcc , who all promptly left the room to my fate, and then threatened to have someone sort me out in uk if I didnt return to finish his job when he finally found the rest of his stone which was lost in the atlantic.
Never a dull day in a tilers life!!

Look forward to sharing other escapades and problems in future and I am supposedly an expert on limsetone as well as pyromania so may be able o help with tech stuff.

A very important lesson gained to anyone who reads here..As a tiler, please ensure you have adequare public liability in place, for just a few pounds a month a new chandelier would be just slightly more on next years policy, in stead of law suits and possible bankruptcy....I wish Johnny the best..........great debate, well done.

i couldnt say much i have never been in this position the fault has to lie on all sides probably the tiler should have used his brain and told the foreman but nobodys perfect we all forget things sumtimes the customer sould have put a note telling the tilers this

ive never claimed touch wood on the insurance yet and i know ur probably feeling guilty but its same with car insurance U SHOULD NEVER ADMIT FAULT even if it was your fault
