I made a claim in county court today against a builder we did a job for a few months ago for our final account payment ,it was remarkably easy ,I downloaded a form from the web filled it out on the computer printed 2 copies and took it to the local small claims court ,there i paid £85 pounds which was added by the clerk to the claim and it was done, very easy process, the clerk told me the company will get 14 days to reply then the court would make a judgement the link for the small business claims is here Her Majesty's Courts Service -Forms and Guidance

good luck Gary have done it a few times even got judgments but still never got any money even on a few times had to pay out so hope it all goes well b*****ds
 
Used it a couple of times and you can do everything on line these days. If you get a judgement and they don't pay up you can pay extra, which is added to their bill to get an enforcement order and then the bailiffs go in.
 
I've got one going through at the minute, in the latter stages hopefully, the court papers have been ignored and the deadline was yesterday, so i've submitted an application for a default judgement + immediate payment in full and court fees.

Done via the online county court www.moneyclaim.gov.uk
exact same forms and process, but you fill everything out online and the court generate the forms and send them out to the defendant.

Very easy to do. Ill keep you posted.
 
I have had to do this on two occasions neither were related to tiling or the business. One was against a retailer for faulty goods because he thought I wouldn't bother and the other time was against a kitchen fitter. They both lost and I was awarded costs and aggro on both occasions. The retailer paid up on time no problem but the kitchen fitter basically ignored the court demand and the court follow up. I spoke to a legal friend of mine and he told me to employ a Private Investigator and get the low down on him, this I did and i got a synopsis of his life and financial position within 72 hours. I filed against him to make him Bankrupt which in his case meant he was means tested and he would have to sell his house because it was an asset. We filed the papers and he settled within 48 hours including an additional £1800 in legal costs and out of pocket expenses and interest accrued. The stupid thing was the original claim was for £1000ish and it cost him close to £4K to settle.

So the moral is "If they fail to settle after losing in small claims and all else fails" This is another route to go!

yes! thanks Dan, the money came a week after I sent the summons and was outside the companies normal cheque run so after being ignored for over 10 weeks and given the run around it came pretty much straight away, :thumbsup:

great m8,justice served in the end.Were you out of pocket at all Gary?
 
No I am not out of pocket, I am just waiting on the retention money which is under £500 ,I priced a £40,000 job for them last year thank God I never started that before I found out they like to make you wait for money :thumbsup:

great info gary,

theres so many people trying their hand nowdays so we all need to be on our toes..the old saying, 'dont mistake my kindness for my weakness' comes to mind!

if you've doen the job right, then you deserve paying on time...end of!!
