As many of you know I recently won a court case against a cutomer who refused to pay for a perfectly fantastic bathroom I completed. I thought I would write a quick guide to the whole claims process.

1-Customer refuses to pay

2-Send a letter recorded delivery stating why you should be paid and give at least 14 days for him to respond

3-If response is unsatisfactory file a claim at your local crown court, £65.00 costs. Include in this all relevant information, be accurate include all dialogiue and dates, claim for all costs and any lost labour if attending court.

4-A hearing fee of £75.00 is now payable. 14 days before the court date both parties must send all information, photos, references they are relying on in court. If you use expert testimony as I did you must write to the judge and ask permission for this otherwise it will not be admissable

5-Arrive at court and put your case forward, call the judge Sir at all times and of course be polite.

To sum up, I made several points to not wanting to waste the courts time and gave the defendant several opportunities to settle, even swallowing my pride and offering to waver my costs.

If you are confident in your work as I was then the courts are there to help, we all hear about tradesman from hell but there are customers from hell as well.
