Fly tipping is the illegal dumping of waste.
The law says that fly tipping can be anything from a bin bag of rubbish to large amounts of waste dumped by builders from trucks.
And it’s not just rubbish dumped on lay-bys or unused land that is illegal – fly-tipped waste can be found anywhere, even on roadsides.
What are the penalties?
Fly tipping is a criminal offence and at best, it could land you with a fine of up to £20,000, and you could even end up behind bars for up to a year. At worst, you could be given an unlimited fine, and up to five years in prison if your case goes to the Crown Court.
How big a problem is it?
In 2005/06, 1,500 prosecutions were made for fly-tipping. It costs the government between £100-150m every year to investigate and clear up fly-tipped waste. Fly-tipping is also bad for the environment and can be harmful to people and wildlife.

Can I be fined if the firm I use to dispose of my waste is fly-tipping?
In short – yes. It’s all too easy to say you didn’t know that the bloke who collects your waste was fly-tipping. That’s why it’s now an offence if your waste is fly-tipped.
So, for your own peace of mind, don’t cut corners, make sure you get the company or person checked out – it only takes a few minutes online, and it could save you a of stress and money in the long run.
If waste you produce is found to be fly-tipped, you could be prosecuted, which means a criminal record, and a maximum fine up £5,000 unless you can provide details of the person/company gave the waste to. This may be a lot harder to produce, because you may not even know the bloke that collects your waste that well, and more often than not, these characters won’t come to your rescue if they get wind of trouble.
