Hi Guys,

just thought I would let you know - it is official, I have had an inspection carried out by a Tile Association registered company and it is basically a bodge job - he agrees with a full hack off and start again.

Should have the written report with relevant extracts from the British Standards.

I will send a copy of it to the tiler, demanding payment in full if not it will be off to the small claims court. Who knows, maybe his dad will come round again :incazzato:

well done mate

youve got them on the ropes now, the time for compromise and deals is past, you gave them ample oppurtunity to make amends

dont get into any debates with them now, short of recieving full costs of previous job and costs of putting the job right you want no more to do with them

let your solicitor do the talking from now on as the other side has no defence whatsever and will have to pay all your costs :hurray:

I can't use a solicitor if going to small claims court - you can't claim legal costs back because that is against the nature of that court track.

To be honest, even if he does declare himself, although it would be a great financial loss to us and may have to holiday locally, he will have to live 100 yrds from us and around people we know. At least I know for sure I am not being a finnicky bl££der :smilewinkgrin:

The only thing that I am prepared to accept now is full renumeration before court, if we go to court it will be all the court costs (which are as clear as mud to figure out - might be £80 or even £230:dizzy2:) and my missed time from work as I have a contract in place to provide services in Munich - so if the court case falls on a Monday/Friday - 1 day, another day 2 days except for a wednesday which would be 1 day plus flight costs).

I have gone above the minimum regarding the report - according to trading standards, an independant report from a tiler who hasn't quoted for the job, and I just need to get two further quotes in for the tiling although I have decided on using the people I have mentioned earlier - they have sent me a quote including ripping out which is a very tempting price as it will save me the next few weekends. The only problem being organising the bath fitting in between as that is currently booked to happen last weekend of this month.

As for payment - it was cash - a very dodgy line to cross if you withhold payment from a tradesman - you should pay and then claim money back. There were a couple in Bournmouth a year or two ago who witheld from a builder. The courts found the builder was shoddy but they were in the wrong for witholding the money. They couldn't claim legal costs and they had to sell the house to pay!!!

When the report comes I will scan and put up on here for you all to see.

Sorry about the essay - just tried to cover all your points.

I wonder if the tiler is keeping an eye on this forum......

hi lawrenso the payment method wasnt about with-holding as you are correct best to pay and claim back. it was just to see if you had something to say that he actually did the job just incase he denies all knowledge later. i know the poss of that is slight but dont want you having any more probs than necc. im sure you wont. good luck and keep us posted.

aaaahhhhhh - the penny drops :thumbsup:. He has admitted it in his letter to me (see previous thread) - short and curlies spring to mind :hurray:
